This is an application for regular bail.

The applicant came to be arrested in Crime No. 308 of 2018 registered at Daund Police Station, Dist-Pune for the offences punishable under Sections 302, 341, 143, 147, 148, 149, 323, 504 & 506 of the Indian Penal Code and under Sections 4, 5, 25 & 27 of the Arms Act. 3.
It is the case of the prosecution that on the date of incident, which took place on 03.05.2018, the present applicant and other co-accused assaulted the deceased by sharp weapons and committed his murder on account of previous dispute.

The bail is sought on the ground of long incarceration as under-trial prisoner. The learned counsel for the applicant submits that the applicant is in jail for about seven years. It is submitted that this Court by order dated 09.10.2023 directed the trial Court to conclude the trial within a period of one year.

On the other hand, the learned APP for the respondent-State submits that the prosecution evidence is over and the trial is at the stage of final argument. It is submitted that at this stage the present application may not be entertained.

Considering the overall facts and circumstances, the trial Court shall endeavour to conclude the trial within a period of three months from the date of receipt of copy of this order or else the trial Court shall release the applicant on bail on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

Application stands disposed of accordingly.
