This is an application for regular bail.

The applicant came to be arrested in Crime No. 164 of 2024 registered at Daund Police Station, District : Pune (Rural) for the offences punishable under Section 302 of the Indian Penal Code and Section 4(25) of the Arms Act. 3.

The deceased was working with Bank of Maharashtra as recovery agent. It is alleged that on the date of incident which took place on 01.03.2024, the deceased was going from Baramati to Patas to distribute recovery notices. It is alleged that at about 7.30 pm when he was within the vicinity of

village Vasunde at that time the present applicant for some unknown reasons assaulted him by sword and committed his murder.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State. 5.

The learned counsel for the applicant submits that the case is based on circumstantial evidence. It is submitted that except tracker dog's evidence, there is no other material to connect the applicant with the alleged crime. 6.

On the other hand, the learned APP submits that considering the nature of offence, the applicant may not be released on bail.

Admittedly, the case is based on circumstantial evidence. The applicant is in jail for approximately one year and the trial has not commenced. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No. 164 of 2024 registered at Daund Police Station, District : Pune (Rural) for the offences punishable under Section 302 of the Indian Penal Code and Section 4(25) of the Arms Act on executing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount;

(iii) The Application stands disposed of accordingly. (N. R. BORKAR, J.)
