By this Application, Applicant is seeking regular bail in Crime No.978 of 2023 registered with Pimpri Police Station, Pune, for the offences punishable under Sections 307, 323, 506 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short), Sections 3(1)(II) and 3(4) of the Maharashtra Control of Organised Crime Act, 1999 ('MCOCA' for short), Section 3 read with Section 25 of the Arms Act and Sections 3 and 7 of the Criminal Law Amendment Act.

It is prosecution's case that,on 28th September 2023 around 9.00 p.m. Applicant and co-accused assaulted the First Informant. The Applicant had tried to fire at First Informant from pistol with an intention to kill him.

It is contention of learned counsel for the Applicant that, the Applicant is behind bar for around 2 years. Investigation is complete and charge-sheet has been filed. No charge is framed against the Applicant. It may take time to conclude the trial and requested to allow the Application.

It is contention of learned APP that, the Applicant is habitual offender. He attempted to kill First Informant by firing from pistol. If the Applicant is released on bail, he may threaten First Informant and prosecution witnesses. Hence, requested to reject the Application.

I have heard both the learned counsel. Perused charge-sheet and the documents produced on record.

In the FIR, there are allegations against the Applicant that, he pointed pistol towards the First Informant, but he did not fire. The Applicant is behind the bar for around two years. Charge is not framed.

It may take time to conclude the trial.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Jatin @ Sonu Bipin Tak be released on bail in Crime No.978 of 2023 registered with Pimpri Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not enter in the jurisdiction of Pimpri Police Station till the recording of evidence of the First Informant except attending Court dates. (iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
