By the present Application, Applicant is seeking bail in Crime No. 1367 of 2019 registered with Chakan Police Station, District Pune for the offences punishable under Sections 75, 302 of Indian Penal Code (for short "IPC") and Sections 4(25)(27) of Arms Act. 3.
Ms. Manisha Tidke, learned APP for the State points out to the order dated 15th September, 2023 passed in Criminal Bail Application No.1197 of 2022 and submits that the earlier Bail Application was withdrawn. She submits that in the event in the change in circumstance, the Applicant would have to move trial court with a fresh Bail Application, at the first instance.

In view of the objection raised by Ms. Manisha Tidke learned APP for the State, Mr. Aniket Nikam on instructions from the Applicant craves leave to withdraw the present Bail Application with liberty to file a fresh bail Application before the Trial Court on the ground of change in circumstances. Request made by Mr. Aniket Nikam not objected to by Ms. Manisha Tidke, learned APP for the State. 5.
In view of the above, leave granted to withdraw the present Bail Application with liberty as prayed. If such Application is filed the same shall be considered on its own merits and in accordance with law. 6.
Bail Application No. 5285 of 2024 is disposed of with the liberty as prayed for.
