This is an application for regular bail.

The applicant came to be arrested in Crime No.238 of 2023 registered at Silvassa Police Station for the offences punishable under Sections 302, 323, 143, 147, 148 and 149 of the Indian Penal Code.

It is alleged that on the date of incident, which took place on 26.5.2023, the present applicant and other co-accused assaulted the deceased with sticks etc. and committed his murder, as he misbehaved with one girl.

I have heard the learned counsel for the applicant and the Dinesh S. Sherla 1/2

31-ba-5317-24.doc learned counsel for the respondent No.1 and perused the statement of witnesses.

It appears that applicant was addicted to liquor and was misbehaving with the people. The applicant is in jail for more than one and half years and the trial is not likely to be concluded in near future as it is still at the stage of framing of charge. Considering overall facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 238 of 2023 registered at Silvassa Police Station for the offences punishable under Sections 302, 323, 143, 147, 148 and 149 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
