Heard Ms. Achari, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent - State of Maharashtra. 2.

This is an Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Bail in connection with C.R. No.28 of 2016 registered with Navghar Police Station for offences punishable under Section 8(C) read with Sections 20 and 29 of Narcotic Drug and Psychotropic Substances Act, 1985. 3.

Mr. Dedhia is directed to take cognizance of attachments to the praecipe inter alia pertaining to the medical condition of the Applicant and call for appropriate report if Applicant requires any treatment. It is informed by Ms. Achari that he fainted in jail resulting

906.BA.5318.2024.doc in grievous injury to his knee. Applicant is also suffering from severe diabetes and medical report are appended to praecipe. 4.

Copy of praecipe alongwith medical report is handed over to Mr. Dedhia. The Investigating Officer is present in Court. He shall place the same before concerned jail /doctors and if required the Applicant shall be referred to JJ Group of Hospital in the following week. The JJ Group of Hospital shall through its Medical Board evaluate the Medical status and condition of Applicant. 5.

Let report be placed before Court after examination of Applicant about status of his medical ailment / injury and treatment that he would require to undertake so that this Court will be in position to consider the medical bail application of Applicant. Let the said report be submitted by 29.01.2025.
