Heard Ms. Dubey, learned Advocate for Applicant; Ms. Pai, learned SPP for Respondent No.1 and Mr. Kulkarni, learned APP for Respondent No.2.

Applicant is incarcerated for past more than four years in jail. Today when the matter is called out for hearing Ms. Pai at the outset informs the Court that Applicant's previous Bail Application was dismissed on merits and the order is appended to Application. Despite that it would not prohibit the Applicant from filing second Bail Application in law as every day of incarceration would be a new ground for maintainability of the Bail Application. Hence that submission of Ms. Pai cannot be countenanced. 3.

Ms. Pai would next submit that she would file Affidavit-in-

914.BA.5339.2024.doc Reply within a period of two weeks if Court allows Union of India to do so. Affidavit-in-Reply is directed to be filed within a period of two weeks from today. Learned SPP for Union of India is directed by this Court to serve a copy of Affidavit-in-Reply on Advocate for Applicant on or before 26.03.2025.
