This is an application for regular bail.

The applicant came to be arrested in Crime No.1070 of 2024 registered at Lonikand Police Station, Dist.Pune for the offences punishable under Sections 109(1), 118(1)(2), 189(1), 191(2)(3), 190 of the Bhartiya Nyaya Sanhita, 2023. 3.
According to the prosecution, on the date of incident, which took place on 09.11.2024, the present applicant and other co-accused assaulted the complainant and his friend by
iron rod and attempted to commit his murder on account of previous dispute.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the applicant is engineering graduate. There are no other criminal antecedents against the applicant. It is submitted that the applicant is in jail for two and half months. It is submitted that considering the overall facts and circumstances, the applicant may be released on bail.

On the other hand, learned A.P.P. for the RespondentState submits that the applicant is involved in serious crime of attempt to murder. It is submitted that considering the nature of the crime, the applicant may not be released on bail. 7.
I have perused the First Information Report. According to the First Information Report, the present applicant has assaulted the friend of the complainant namely Abhishek Mujumale. The learned A.P.P. submits that said Abhishek lost his vision. However, there is no certificate to that
effect in the papers of in the investigation. Considering the overall facts and circumstances and as there are no other criminal antecedents against the applicant, I am inclined to release the applicant on bail.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No.1070 of 2024 registered at Lonikand Police Station, Dist.Pune for the offences punishable under Sections 109(1), 118(1)(2), 189(1), 191(2)(3), 190 of the Bhartiya Nyaya Sanhita, 2023 on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) The applicant shall not enter into the limits of Taluka Shirur till the conclusion of trial.
(v) Application stands disposed of accordingly.
