After hearing the matter for some time, Mr. Sharma, learned Counsel for the Applicant, seeks permission to withdraw the present application with liberty to file a fresh application if charges are not framed within the next 6 months.

Ms. Bajoria, learned APP for the State, submits that on 16th April 2025 and 26th June 2025, the matter was kept for framing of charges before the Trial Court. However, on 11th September 2025

17-BA-5408-2024.DOC account of adjournments sought by the Counsel for the Applicant appearing before the Trial Court, charges were not framed. She states that the next date for hearing is on 17th September 2025 before the Trial Court.

Mr. Sharma, on instructions, states that the Applicant will not seek further adjournment if the Trial Court commences to frame charges in the criminal case. He undertakes to cooperate and not seek an adjournment on that date.

On the aforesaid statements of both the Counsel, permission as sought is granted. The application is accordingly disposed of as withdrawn with the aforesaid liberty.
