Heard Mr. Saraf, learned Advocate for Applicant; Mr. Shirsat, learned Special Counsel for Respondent No.1 - Union of Indian and Mr. Karmakar, learned APP for State of Maharashtra. 2.

Application is moved for medical reason. Advocate appearing for Applicant without informing the reasons has attempted to argue the matter on merits. It is only at the end of argument, Mr. Shirsat informed the Court that matter was listed for medical urgency when this Court realised the above issue.

Considering the medical exigency expressed by learned Advocate, Chief Medical Officer of the prison Hospital where Applicant has been lodged shall prepare a report and submit the same with

35.BA.5432.2024.doc respect to his medical condition. Advocate has attempted to show some medical papers, the same are handed over to Mr. Shirsat. Mr. Shirsat shall forward the same to Investigating Officer who shall place before concerned Chief Medical Officer of Hospital where Applicant has been lodged. Let the report be submitted within a period of two weeks from today.
