Heard Mr. Sanjkar, learned Advocate for Applicant; Mr. Dedhia, learned APP for Respondent No.1 - State and Ms. Balasubramaniam, learned Advocate for Respondent No.2 through Legal Aid.

In the present case Applicant is the father of the prosecutrix. First Informant is the mother of the prosecutrix. Prosecutrix - victim is 7 years old at the time of incident. The tenure is over a period of 5 months as informed by the learned appointed Advocate for Respondent No.2. Prima facie the case of the Applicant is that there were certain disputes between the Applicant and First Informant and therefore a false First Information Report (FIR) has been filed.

Learned appointed Advocate has informed the Court that medical examination is inconclusive since it has been refused by the prosecutrix and the First Informant. In that view of the matter, if any 164 statement has been recorded by the prosecution before the Magistrate, the learned Prosecutor appearing in the matter is directed to place the same before Court to enable the Court to consider the case of Applicant and prosecution.

Let the statement be placed before the Court on the next adjourned date. Prosecution is also directed to come with 2 spare copies of the statement for the learned Advocate for Applicant and learned appointed Advocate for Respondent No.2. 5.
