The Applicant is seeking anticipatory bail in connection with C.R.No. 580 of 2022 registered at Bhandup Police Station, under Sections 420, 465, 467, 468 and 471 r/w. 34 of the Indian Penal Code. At the outset, learned APP is seeking adjournment as the investigating officer is on sick leave. At her request, today I am adjourning the matter. However, I have heard the parties for consideration of grant or refusal of ad-interim relief. 2.

applicant was working with the first informant. The informant was in need of a house. It is his case that the applicant told him that a flat was available in S.R.A. scheme at Bhandup for Rs.18 lakhs, though, the price of a flat in that area was around Rs.40 lakhs to Rs.50 lakhs. The informant was introduced by the applicant to Krushnakant Sonwadkar and Rajkumar Verma. Both of them showed a room to the informant. He decided to purchase that room. Both these persons gave him the forged documents in the nature of SRA transfer receipt, electricity bills etc. They obtained around Rs.4,01,000/- from the informant. But it turned out that all those documents were forged and the informant was not given any flat. On this basis the F.I.R. was lodged.

Learned counsel for the applicant submitted that the applicant himself was looking for purchasing a flat and thus, he came in contact with the other two persons who were the main accused. He had only introduced those two accused to the informant. He is not concerned with the activities of the other two accused.

Considering these submissions, the applicant can be protected by way of ad-interim relief till the next date. 5.

Hence, the following order.

O R D E R

i) In the event of his arrest in connection with C.R.No. 580 of 2022 registered with Bhandup Police Station, till the next date, the Applicant be released on bail on his executing P. R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

ii) This order shall operate till 02/02/2024. iii) Stand over to 02/02/2024.
