Apprehending arrest at the hands of Police in connection with Crime No.645/2023, registered with Police Station Jalgaon (Jamod), District Buldhana for the offence punishable under Sections 304-B, 306, 323 read with Section 34 of the Indian Penal Code.

The applicants, who are parents in law of the deceased and the deceased died on 26.11.2023, as she committed suicide, when she was staying at her parents house. It is alleged that marriage of the deceased was performed on 4th May, 2023 with co-accused Ravi Pralhad Ugalkar. The deceased was qualified as a B.E. and was doing a job at Pune in private company. She was ill-treated by the present applicants and the other co-accused for demand of money for purchasing the tractor and also assaulted for the same. Therefore, she left the matrimonial house and went at her parents house and thereafter committed suicide.

Learned counsel for the applicants submitted that as far as husband and other two sister-in-law are concerned they are already released on bail by the Sessions Court. Present applicants are aged about 70 and 65 years old and are residing at Rudhana, Tahsil Sangrampur, District Buldhana, whereas deceased was serving at Pune. The deceased has not stayed more than 8 days alongwith present applicants at her matrimonial house. The alleged incident has taken place at her parents house. Merely because deceased has committed suicide, the present applicants and other family members were implicated in a false case. As far as custodial interrogation is concerned, which is not required, considering the allegations against them and prays for releasing them on anticipatory bail. 4.
Learned Additional Public Prosecutor for the respondent State has strongly opposed the application on the ground that there are allegations that present applicants have demanded dowry from the deceased and therefore, she committed suicide.

After hearing learned counsel for the applicants and learned Additional Public Prosecutor for the respondent State. Perused the recitals of F.I.R. It reveals that the deceased was Engineer by profession and was serving at Pune. The recitals of the F.I.R. itself shows that for some days she stayed at her matrimonial house at Rudhana and thereafter joined her job at Pune. As far as allegations are concerned which are general in nature against the present applicants.
Their custodial interrogation is not required. In view of that, interim
aba15.24.odt 3/3 protection granted to them deserves to be confirmed. Accordingly, I proceed to pass following order :
O R D E R
(i) The application is allowed.
(ii) In the event of arrest of the applicants - Pralhad Ugalkar and Parvatibai Pralhad Ugalkar in connection with Crime No.645/2023, registered with Police Station Jalgaon (Jamod), District Buldhana for the offence punishable under Sections 304-B, 306, 323 read with Section 34 of the Indian Penal Code be released on anticipatory bail on execution PR Bond in the sum of Rs.25,000/- each with one solvent surety in the like amount.
(iii) The applicants shall attend concerned Police Station as and when required for the investigation purpose and shall co-operate with the Investigating Agency.
(iv) The applicants shall not directly or indirectly induce, threat or promise any witnesses, who are acquainted with the facts of this case.

The application is disposed of.
