The Applicant, at the first instance, was granted bail by the Additional Sessions Judge, Pune vide order dated 9.6.2023. Thereafter it was cancelled at the instance of the first informant who had filed Criminal Bail Application No.7506/2023. The order of cancellation of bail was passed by the Additional Sessions Judge, Pune on 11.12.2023. After that the present Application is filed for relief of anticipatory bail. The bail was cancelled because of violation of conditions.

Since the bail of the Applicant was cancelled at the instance of the first informant, he is a necessary party. No orders can be passed without hearing him. Therefore, learned counsel for the Applicant is directed to add the first informant as the Respondent No.2 in this case. Amendment shall be carried out forthwith.

Issue notice to the added Respondent returnable on 23.1.2024. The investigating officer shall inform the added Respondent about pendency of this application and next date of listing.

Stand over to 23.1.2024.
