The Applicants are seeking anticipatory bail in connection with C.R.No.327 of 2023 registered with Meghwadi Police Station, Mumbai, on 17.09.2023, under Section 306 r/w. 34 of the Indian Penal Code.

The F.I.R. is lodged by one Mansi Patel regarding suicide committed by her husband Vipul Patel. The F.I.R. mentions that the deceased was working with M/s. other accused in the said firm. In one transaction the company lost Rs.42 lakhs, for which, one of the partners had made complaint against the deceased and one Monishbhai. After that, a complaint was lodged at Varachha police station, Surat. The deceased was under pressure. He committed suicide on 13.09.2023. In the suicide note left behind by him, the names of the present applicants along with other partners of the said firm were mentioned as the persons responsible for his suicide. 3.

Learned counsel for the applicants submitted that another co-accused Rasikbhai has preferred A.B.A.No.3199 of 2023 before this Court, in which, interim protection was granted to him. That matter was slated to be listed on 24.01.2024. He submitted that, there is no direct nexus between the suicide committed by the deceased and the roles attributed to the present applicants.

Considering these submissions, the present application can be heard with the aforementioned application of the coaccused and the applicants can be similarly protected.

Hence, the following order.

O R D E R

i) In the event of their arrest in connection with C.R.No.327 of 2023 registered with Meghwadi Police Station, Mumbai, till the next date, the Applicants be released on bail on their executing P. R. bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand each Only) with one or two sureties each in the like amount.

ii) This order shall operate till 24/01/2024. iii) The Applicants shall attend the concerned Police Station on 22/01/2024 and 23/01/2024 between 1.00 p.m. to 5.00 p.m. and shall cooperate with the investigation.

iv) This application is to be heard along with A.B.A.No.3199 of 2023.

v) Stand over to 24/01/2024.
