The Applicant is seeking anticipatory bail in connection with C.R.No.I-658/2023, dated 04/12/2023 registered with Kalwa Police Station, Thane City, under sections 498-A, 323, 500, 504, 506 of the Indian Penal Code.

The Applicant is the husband of the first informant. She has alleged that after their marriage on 13/05/2022 she started residing with the Applicant's family, but slowly her in-laws and the Applicant started ill-treating her. The Applicant was addicted to liquor and used to abuse her and assault her. There are allegations that the Applicant's mother did not allow her to wear her own ornaments. There are allegations that the Applicant displayed her mobile number and Instagram ID on telegram app. The Applicant and his family did not go to the informant's parent's house for their first Diwali festival. On this basis, the FIR is lodged.

Today, learned APP is seeking adjournment.

Learned counsel for the Applicant submitted that the Applicant had initially tried to patch up the differences and therefore he had filed Petition for Restitution of Conjugal Rights, but since there was no response from the informant, he withdrew it and filed Divorce Petition in June 2023. As a
3 / 4 counterblast to that, the first informant has filed this FIR in December 2023. He submitted that the Applicant is desirous of entering into settlement.

Considering these submissions, the Applicant can be protected by way of ad-interim relief.

Hence, the following order :
O R D E R
(i) Issue notice to the Respondent returnable on 29/02/2024.
(ii) In the event of his arrest in connection with C.R.No.I-658/2023, dated 04/12/2023 registered with Kalwa Police Station, Thane City, till the next date, the Applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.
4 / 4 (iii) This order shall operate till 29/02/2024.
(iv) The Applicant shall cooperate with the investigation in the meantime.
(v) Stand over to 29/02/2024.
