The Applicant is seeking anticipatory bail in connection with C.R. No.870 of 2023, registered with Akluj Police Station, Solapur on 12th December 2023.

Heard Mr. V. V. Purwant learned counsel for the Applicant and Ms. Pallavi N. Dabholkar, learned APP for the State.

Learned APP seeks some time because Investigating Officer is not present and she does not have any instructions. Today I have heard the parties for consideration of ad-interim

The FIR is lodged by the father of the victim who is about 17 years and 10 months of age. She was missing since 12th December 2023. The informant suspected that somebody had induced her to elope. On this suspicion, the FIR under Section 363 of IPC was registered.

Learned counsel for the Applicant submits that the Police are suspecting the Applicant's son as the person who had eloped with the victim and, therefore, they are harassing the Applicant's family members including the Applicant. Therefore, she has reasonable apprehension of being arrested. 6.
I have considered these submissions. The FIR is lodged against unknown persons. At the highest, the allegations against the Applicant are that she is the mother of the main suspect. Beyond that, there is hardly any material against her, at this stage, atleast as seen from the FIR. In this view of the matter, she can be protected by way of ad-interim relief with directions to her to attend the Police Station and to co-operate with the investigation.

Hence, the following order :
O R D E R
(i) In the event of her arrest in connection with C.R. No.870 of 2023 registered at Akluj Police Station, Solapur till the next date, the Applicant be released on bail on her executing P.R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.
(ii) The Applicant shall attend the concerned Police Station on 23rd January 2024 and 24th January 2024 between 1.00 P.M. to 4.00 P.M. and thereafter as and when called.
(iii) This order shall operate till 1st February 2024. (iv) The Applicant shall cooperate with the investigation.
(v) Stand over to 1st February 2024.
