In this application, by order dated 19.01.2024, this Court (Coram: Sarang V. Kotwal, J) granted interim order in favour of the applicant, subject to specific conditions, including a direction that the applicant shall appear before the concerned police station on 05.02.2024 to 08.02.2024 and thereafter, as and when called. The applicant was also directed to co-operate with the investigation.

The learned counsel for the applicant submits that the applicant has abided by the said direction and he has co-operated with the investigation. It is submitted that documents were also produced before the investigating officer, but for some reason, they were not accepted. Hence, copies of the documents were placed on record with the present application. by PRIYA KAMBLI Date:

In this situation, this Court is satisfied that the applicant has cooperated with the investigation and indeed abided by the conditions imposed by this Court.

It is to be noted that while granting interim relief in favour of the applicant, this Court took note of the specific submissions made on behalf of the applicant that at the relevant time, there was no document to show that statutory audit was conducted, before the complaints were made in the present case. It is noted that a statutory audit was in fact carried out and according to the applicant, who was the manager of the co-operative credit society, there were discrepancies therein and in respect thereof, the applicant himself had lodged a complaint.

In view of the above and particularly in the light of the fact that the applicant has abided by the directions issued in the order dated 19.01.2024, this Court is inclined to continue the interim order and allow the application. 6.

Accordingly, interim order dated 19.01.2024 is confirmed and the application is allowed.

The applicant is directed to continue to co-operate with the investigation. He shall not tamper with the evidence of the prosecution in any manner. He shall also not influence the informant, witnesses and other persons concerned with the case.
