The Applicant is seeking anticipatory bail in connection with C.R.No.1176/2023 registered with Sakinaka Police Station, Mumbai under Sections 420 read with 34 of IPC. 2.
Heard Mr. Sanjay Singh, learned counsel for the Applicant and Ms. Pallavi Dabholkar, learned APP for the Respondent-State.

The FIR is lodged by one Pravin Bhalerao. He was working as a Nodal Officer with the company known as 'Cars24'. The Applicant was also employed with the said company. The company has many dealers throughout the country. The allegations against the Applicant are that the City Head of the Company Mrs. Jinita Shah came to know in June, 2023 that the Deshmane(PS)

Applicant was using the company's data illegally and used to provide it to various dealers and used to get monetary benefits from them. The beneficiaries mostly were 'M.D Motors' and 'Lucky Motors'. On these allegations the FIR is lodged. 4.
Learned counsel for the Applicant submitted that the Applicant was given some money by the customers because of his good performance and getting good deals for the customers, but, he has not caused any loss to the informant's company. He submitted that the Applicant has not used any data to the detriment of the company.

Learned APP submitted that the investigation has revealed that the Applicant was directly dealing with the customers and was using the informant's company's data. 6.
Considering these submissions, it is necessary that the Applicant explains his stand before the investigating agency and shows all the transactions in which he had received money and that those transactions had nothing to do with the company's data. For that purpose, the Applicant will have to attend the concerned police station and explain his stand.

Therefore, today I am protecting the Applicant by way of adinterim relief so that the Applicant can attend the police station and explain his case.

Hence, the following order:
O R D E R
(i) In the event of his arrest in connection with C.R.No.1176/2023 registered with Sakinaka Police Station, Mumbai, till the next date, the Applicant be released on bail on his executing a P.R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.
(ii) This order shall operate till 11.3.2024.
(iii) The Applicant shall attend the concerned Police Station from 12.2.2024 to 15.2.2024 between 1:00 p.m. to 5:00 p.m. and thereafter as and when called. The Applicant shall cooperate with the investigation.
(iv) Stand over to 11.3.2024.
