The Applicant is seeking anticipatory bail in connection with C.R.No.6/2024, dated 02/01/2024, registered with Andheri Police Station, Mumbai, under sections 420, 465, 467, 468, 471, 120-B of the Indian Penal Code.

Heard Mr. Jitendra V. Tiwari, learned counsel for the Applicant and Smt. M. H. Mhatre, learned APP for the State. 3.

2 / 4 which was a company inspecting claims of other health insurance companies. The FIR mentions the procedure for verifying the claims made by the patients. The allegations in the FIR are about sanctioning of 26 fraudulent claims from members of one family. These fraudulent insurance claims of Rs.31,28,203/- were passed. The FIR raised suspicion against the present Applicant who was working with Vidal Health Company, as a member of the investigating team. 4.

Learned counsel for the Applicant submitted that even assuming that those claims were fraudulent, there is nothing to show that the present Applicant had any connection with the passing of those claims. He had not prepared any report, he had not signed any document. It was not part of his job alone to pass the claim. There is a hierarchy in the company and the superiors verify the claims and investigation made in respect of those claims.

Learned APP on instructions of the Investigating Officer

3 / 4 submitted that, as today, except for the FIR there is only the statement of one Sachin working with the company who has stated in the same manner as the first informant. This is the only material against the present Applicant. She submitted that for the time being the Applicant can be protected with directions to attend the concerned police station.

Considering both these submissions, the Applicant can be protected by way of ad-interim relief.

Hence, the following order :

O R D E R

(i) In the event of his arrest in connection with C.R.No.6/2024, dated 02/01/2024, registered with Andheri Police Station, Mumbai, till the next date, the Applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like

(ii) The Applicant shall attend the concerned Police Station from 20/02/2024 to 22/02/2024 between 01.00 to 05.00 p.m. and thereafter as and when called and shall cooperate with the investigation.

(iii) This order shall operate till 12/03/2024.

(iv) Stand over to 12/03/2024.
