First anticipatory bail application filed by the applicant has been dismissed vide order dated 17.01.2023 passed in Criminal Application No.296/2022. Two criminal applications were decided together. One was filed by the present applicant and the other filed by co-accused namely, Mukund Jamnadas Vyas. By order dated 17.01.2023, the anticipatory bail applications filed by both the applicants were rejected. The applicant approached the Supreme Court in Special Leave Petition No.4300/2023 and the Supreme Court, vide order dated 23.08.2023, dismissed the Special Leave Petition. 3.

The applicant has filed yet another application on the ground that the charge-sheet has been filed. The applicant is however shown as absconding. The learned counsel states that the evidence has been collected against the applicant as well. Despite such status, he has been not named in the charge-sheet.

Learned A.P.P., on instructions, submits that the prosecution is likely to file charge-sheet against the applicant in the next 30 days.

In the meantime, the applicant shall attend Police Station, Wathoda, Nagpur City, Nagpur on 25.06.2024, 26.06.2024 and 27.06.2024 at 11:00 a.m. and, thereafter, as and when called by the investigating officer. 6.

In such an eventuality, if the investigating officer deems it necessary to arrest the applicant, he will be at liberty to do so. However, in the event, the applicant is arrested, he shall be released forthwith on bail on furnishing P.R. Bond in the sum of Rs.25,000/-.
