The Applicant is seeking anticipatory bail in connection with C.R.No.111 of 2023 on 25/05/2023 registered at Naigaon Police Station, under sections 420, 406, 506 r/w 34 of the Indian Penal Code.

Heard Ms. Manjiri Parasnis,learned counsel for the applicant and Ms. Mahalakashmi Ganapathy, learned APP for the State.

Gist of the FIR is that the Applicant was an agent and he represented to the informant that one Chandana family had a

land available for sale. The informant was impressed and decided to purchase that land. The FIR mentioned that in all he paid Rs. 1,39,50,000/- to all the accused but subsequently the land was not transferred in his name. The money was misappropriated and the offence was registered.

Learned counsel for the Applicant, without prejudice to the rights and contentions of the Applicant, makes a statement that the Applicant is willing to deposit amount of Rs. 79 lakh which has came to his share in these transactions within reasonable time. The statement is recorded. Considering this statement, it is necessary to hear the first informant. Thus, strictly on the basis of this statement, today, I am granting ad-interim protection to the Applicant. Hence the following order.

ORDER

(I) In the event of his arrest in connection with C.R.No. 111 of 2023, registered at Naigaon Police Station, till the next date, the Applicant is directed to be released on bail on his executing P.R. bond in the sum of

Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

(ii) This order shall operate till 03/04/2024.

(iii) Learned counsel for the Applicant shall add the first informant as a party Respondent forthwith.

(iv) Issue notice to the added Respondent returnable on 03/04/2024.

(v) The Applicant shall attend the concerned Police Station as and when called.

(vi) Stand over to 03/04/2024.
