Bail Application No. 631 of 2024 is Accused No.4 Bharat Govind Dhumal.

The Applicants are seeking pre-arrest bail in connection with C.R. No. 78 of 2023, registered at Yeola Police Station, Nashik on 21st March 2023 under Sections 406 and 420 read with Section 34 of the Indian Penal Code, 1860.

The F.I.R. is lodged by one Suryakant Tukaram Gangurde, who was Auditor of Dhanlaxmi Mahila Nagarik Sahakari Sanstha Maryadit, Yeola, District-Nashik. He had conducted audit between 26th November 2020 to 26th February 2021. The gist of the F.I.R. is that the Applicant Nos.1 and 2 in ABA No. 622 of 2024 are the Chairman and Vice Chairman of the said Society. They sanctioned loan of Rs.2,60,00,000/- to the other Applicant- Bharat Dhumal in ABA No. 631 of 2024. This amount was sanctioned in violation of rules and regulations. The Applicant Bharat Dhumal repaid the loan amount in cash and the received cash was used in refunding the deposits of different depositors whose names are mentioned in the F.I.R.

It is submitted by Mr. Deshmukh, learned Counsel appearing for the Applicants that the Applicant-Bharat Govind Dhumal had mortgaged the property as security for the loan and after selling his land, he had repaid the entire loan amount. He submits that there is no misappropriation by either of the Accused and the entire loan amount is repaid.

A learned Single Judge by Order dated 27th March 2024 has granted interim protection. The said protection is continued till date.

Learned APP states that the investigation is completed and the Charge-sheet will be filed within a period of one month from today.

Thus, the case is made out for grant of interim protection. Accordingly, the Applicants are entitled to pre-arrest bail. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicants - Mrs. Surekha Bharat Dhumal, Mrs. Vandana Yogesh Surade and Mr.
Bharat Govind Dhumal be released on bail in C.R. No.78 of 2023, registered with Yeola Police Station, Nashik on executing P.R. bonds of Rs.50,000/- each and furnishing one or two sureties in the like amount. (ii) The Applicants shall attend the concerned Police Station as and when called by the Investigating Officer.
(iii) The Applicants shall furnish their cell phone numbers and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(iv) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.
(vi) The Anticipatory Bail Applications are allowed and disposed of accordingly.
