The order dated 20.3.2024 records the statements on behalf of the Applicant that the Applicant had no intention to misappropriate the amount of the informant and that the Applicant understands that the informant had lost his hard earned money. The Applicant wanted to genuinely return the money but he needed some reasonable time to refund the money with the help of the co-accused. Strictly based on this statement, I had granted ad-interim PRADIPKUMAR PRAKASHRAO DESHMANE relief to the Applicant.

Learned counsel for the intervenor - first informant states that till today nothing is given by the Applicant to the informant.

Learned counsel for the Applicant states that on few occasions, the Applicant tried to hand over cheques but the informant did not accept it.

Considering this situation, the Applicant shall file an affidavit supporting the statements made on his behalf before this Court on 20.3.2024. It is made clear that the merits of the matter are left open and only by way of indulgence based on the statements made by learned counsel for the Applicant, the question of refund of money was considered.

Stand over to 17.10.2024. Ad-interim relief, granted earlier, to continue till then. The Applicant shall file an affidavit, referred to hereinabove, on or before that date, with copy to the other side.
