Mr. Mayur S. Sonavane, APP for Respondent-State. Mr. Bhagwan S. Gurav, PSI, EOW, Pimpri Chinchwad. ****** CORAM: MANISH PITALE, J.
DATE : 30th JULY 2024 P.C. :
.
The documents available on record, on the face of it, show that there is no substance in the present application. The reasons for the same are as follows :
(a) The FIR was registered as far back as on 3rd January 2017.
(b) Initially, the applicant was granted anticipatory bail, but subsequently the same was cancelled.
(c) The applicant had challenged cancellation of bail, but the challenge was turned down by this Court and the order of this Court was challenged before the Supreme Court.
bipin prithiani 911-aba-771.24.doc (d) By an order dated 19th May 2020, the Supreme Court rejected the Special Leave Petition filed by the applicant and observed that dismissal of the Special Leave Petition would not come in the way of the petitioner to pursue regular bail application, which could be filed after surrendering before the concerned Court.
(e) Admittedly, despite the aforesaid chronology of events, the applicant did not surrender and continued to apply for anticipatory bail.
(f) The Sessions Court in the most recent application filed by the applicant, dismissed the same by an order dated 18th January 2024.
2.
Considering the aforesaid sequences of events fairly pointed out by the learned Senior Counsel appearing for the applicant and in the light of the submissions made by the learned APP, this Court finds no substance in the present application. 3.
Accordingly, the application is dismissed.
