The Applicant is seeking anticipatory bail in connection with C.R.No.736 of 2023 registered at Ambad Police Station, Nashik city, on 27.11.2023, under Sections 498-A, 376, 506 r/w. 34 of the Indian Penal Code.

Heard Mr. Sachin Chandan, learned counsel for the applicant and Mr. Mali, learned APP for the State. 3.
The F.I.R. is lodged by the victim herself. She has stated that, she got married with her husband on 13.03.2013. She started residing with her husband and his family members in Mumbai. Since May 2023, there used to be matrimonial quarrels between Digitally signed by VINOD BHASKAR GOKHALE Date:

the informant on one side and her husband and his other family members on the other. It is mentioned in the F.I.R. that, she was taken to her parent's house at Nashik. It is further mentioned in the F.I.R. that the applicant was a distant relative of her husband. He came to her house in Nashik when no one else was there and he established forcible physical relations with her. It is mentioned that, he had taken her photographs and he started blackmailing her. On one occasion, he called her to a hotel at Nashik and again established forcible physical relations with her. On these allegations the F.I.R. was lodged.

Learned counsel for the applicant submitted that the applicant and the informant were in consensual relationship. The applicant has recorded all their messages exchanged between them. He produced that conversation for the perusal of the Court and also gave one copy to the learned APP.

Learned APP submitted that, he needs to verify the authenticity of this conversation and needs to verify it with the informant. He seeks time.

Considering this situation, today I am adjourning the matter. However, based on the messages, as of today the applicant can be protected by way of ad-interim relief. 7.
Hence, the following order.
O R D E R
i) In the event of his arrest in connection with C.R.No.736 of 2023 registered at Ambad Police Station, Nashik city, till the next date, the Applicant is directed to be released on bail on his executing P. R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.
ii) This order shall operate till 24/04/2024. iii) The Applicant shall attend the concerned Police Station from 02/04/2024 to 04/04/2024 between 1.00p.m. to 5.00p.m. and thereafter as and when called and shall cooperate with the investigation.
iv) Stand over to 24/04/2024.
