Heard Mr. Rankhambe, learned Counsel appearing for the Applicants, Mr. Mangaonkar, learned APP appearing for the Respondent No.1-State and Mr. Dande, learned Counsel appearing for the Respondent No.2.

This application is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail in connection with C.R. No129 of 2024 registered with Pimpri-Chinchwad Police
Station, Pune, for the offence punishable under Sections 377, 498A, 323, 504, 506 read with 34 of the Indian Penal Code, 1860 and under Section 4 of the Dowry Prohibition Act, 1961. 3.
A learned Single Judge (Coram: Sarang V. Kotwal, J.) by order dated 22nd March 2024 has granted protection to the Applicants. The said protection is continued till date i.e. for a period of 1 and 1/2 years. Chargesheet has already been filed on 17th September 2025. A learned Single Judge (Coram: Rajesh S. Patil, J.) by further order dated 5th February 2025 inter alia recorded the submission of Mr. Rankhambe, learned Counsel appearing for the Applicants that only one gold ornament in the form of gold chain which was gifted by father-in-law of the Applicant No.1, during the marriage of the Respondent No.2's brother is lying with him and he is ready to give back the same to the Respondent No.2.

Mr. Rankhambe, learned Counsel states that the said gold chain is of 5 grams. He states that the Applicants are ready to handover the same to the Respondent No.2 in the presence of the Investigating Officer and that tomorrow the Applicants are ready to handover the same in the presence of the Investigating Officer.
Mr. Dande, learned Counsel appearing for the Respondent No.2 states that without prejudice to the rights and contentions of the Respondent No.2, the Respondent No.2 will accept the said gold chain.

As the investigation is completed and the chargesheet has already been filed, the Anticipatory Bail Application is disposed of in terms of the order dated 22nd March 2024 passed by the learned Single Judge.
