The Applicant is seeking anticipatory bail in connection with C.R.No.596/2023 registered at Sadar Bazar Police Station, Solapur on 2.9.2023 under Sections 417, 420 read with 34 of IPC and under Section 83 of the Registration Act.

Heard Mr. Abhinav Bhatkar, learned counsel for the Applicant and Ms. Mahalakshmi Ganapathy, learned APP for the Respondent-State.

The investigating officer is not present today and learned APP is seeking time. Therefore, I have heard the parties for consideration of the ad-interim protection. 4.

The FIR is lodged by the Sub-Registrar, Solapur North-2. The FIR arises out of a complaint made by one Laxmi Shriram Kadam. The FIR pertains to a partition deed executed between Shriram Kadam and his brothers. According to her, Shriram Kadam was missing since past 30 to 35 years. Somebody had posed himself as Shriram Kadam and had signed the documents in the nature of partition deed and the relinquishment deed. On this basis, the FIR is lodged.

Learned counsel for the Applicant submitted that the role attributed to the present Applicant was that he was a witness to those documents. One of the main beneficiaries Ramchandra Kadam in those documents is granted adinterim protection vide order dated 4.1.2024 passed in A.B.A. No.3634/2023. That matter is to be listed on 3.4.2024. He submitted that considering the Applicant's

lesser role than Ramchandra Kadam, he may be protected till the next date. I find force in this submission. Therefore, the Applicant can be protected the till next date. Hence, the following order:

O R D E R

(i) In the event of his arrest in connection with C.R.No.596/2023 registered at Sadar Bazar Police Station, Solapur, till the next date, the Applicant be released on bail on his executing P.R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

(ii) This order shall operate till 3.4.2024.

(iii) Stand over to 3.4.2024. This matter shall be tagged with A.B.A No.3634/2023.
