DATED:- 4th APRIL, 2024 PC:- 1) Heard the learned Counsel for the parties.
2) This application is preferred for pre-arrest bail in connection with CR No. 127 of 2023, registered with Nagothane Police Station, for the offences punishable under Sections 406, 408 and 420 read with Section 34 of the Indian Penal Code, 1860.
3) The learned Counsel invites the attention of the Court to an order dated 11th October, 2023, in ABA No. 2854 of 2023, whereby the co-accused - Shilawati Khelu Gaikar @ Gaikwad 1/3
has been granted interim protection. The applicants are also stated to be the members of Ainghar Village Panchayat and similarly circumstanced.
4) As the co-accused have been granted interim protection, it may be expedient to grant the same dispensation to the applicant and list this application along with ABA No. 2854 of 2023.
5) Hence, the following order.
: O R D E R :
(i) In the event of the arrest of the applicants, the applicants be released on bail in CR No. 127 of 2023, registered with Nagothane Police Station, for the offences punishable under Sections 406, 408 and 420 read with Section 34 of the Indian Penal Code, 1860, on furnishing a P.R. Bond in the sum of Rs30,000/- each, with one or two sureties in the like amount.
(ii) The applicants shall co-operate with the investigation and attend Nagothane Police Station on 10th, 11th and 12th April, 2024 and, thereafter, as and when directed by the Investigating Officer.

iii) The applicants shall not tamper with the prosecution evidence and/or give threat or inducement to the first informant and any of the persons acquainted with the facts of the case.
iv) Stand over to 17th April, 2024. To be listed along with ABA No. 2854 of 2023.
