Apprehending the arrest at the hands of police in connection with Crime No.740/2024 registered with Malkapur City Police Station, District Buldhana for the offences punishable under Sections 74, 75, 78, 296, 115(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023, the applicant approached this Court for grant of pre-arrest bail. 2.
Heard learned Counsel for the applicant. Perused the recitals of the FIR from which it reveals that the crime is registered on the basis of report lodged by the victim aged about 38 years who stated that her husband died in the year 2022. He was serving in M.S.E.B. Office and present applicant has to take the amount of Rs.3,00,000/- from her husband and he was harassing her on the pretext
(2) 12.aba.855.2024 that either she has to pay the amount of Rs.3,00,000/- otherwise, she should give him sexual favours. On 04.12.2024 the applicant came near Janta College and assaulted her by means of a belt, abused her and forcefully took her on motorcycle and took her at Radheya Hotel, Malkapur and again asked for the sexual favours on her resistance, he has also assaulted her and several persons gathered at the relevant time. Considering the allegation in the FIR, at this stage, I have shown my disinclination to grant ad-interim protection to the present applicant. 3.
Learned APP waives service of notice for the State and seeks time to file reply.
