Heard the learned counsel for the applicant and the learned APP for the State.

This is an application for pre-arrest bail in connection with C.R. No. 127 of 2023 registered at Nagothane police station for the offences punishable under sections 406, 408 and 420 read with 34 of Indian penal Code, 1860.

By an order dated 11th October, 2023 ad-interim relief was granted to the co-accused Dipak Chiplunkar who is similarly circumstanced.

The learned APP submits that in another matter, this Court has granted ad-interim relief to the co-accused and all the Bail Applications have been directed to be listed on 17th April, 2024. 5.

Chiplunkar, this Court has inter alia noted that the question as to whether it was a case of irregularity in execution of the development work or criminal misappropriation would warrant investigation. In view of above, the applicant is also entitled to the same dispensation.

Hence the following order.

ORDER

1] In the event of arrest in C.R. No. 127 of 2023 registered with Nagothane police station, the applicant Sunil Ragho Sute be released on bail on furnishing a P.R. bond in the sum of Rs.30,000/- with one or two sureties in the like amount. 2] The applicant shall cooperate with the investigation and attend Nagothane police station, on 14th, 15th and 16th April, 2024 in between 10 am to 1 pm and, thereafter, as and when directed.

3] The applicant shall not tamper with the prosecution evidence and give threat or inducement to first informant, any of the prosecution witnesses or any person acquainted with the facts of the case.

4] List on 17th April, 2024.

5] To be listed along with Anticipatory Bail Application Nos. 2843 of 2023 and 834 of 2024.
