Apprehending the arrest at the hands of police in connection with Crime No. 741/2024 registered with Police Station Mangrulpir, Tq. Mangrulpir, District Washim for the offence punishable under Sections 109, 296, 3(5), 351(2) and 351(3) of the Bhartiya Nyaya Sanhita, 2023, the applicant approached this Court for grant of pre-arrest bail.

Heard learned counsel for the applicant to some extent, perused the recitals of the FIR, and the order passed by the Sessions Court. From the recitals of the FIR, it reveals that the specific role is attributed to the present applicant that he has assaulted the father of the informant by means of stick on his head, i.e. on the vital part, and sustained the grievous injury. The police report also shows that from the date of the incident, the present applicant is absconding. The order passed by the Sessions Court also shows that the applicants and the other co-accused have rkn
4aba863.2024.odt assaulted the injured by means of iron rods, i.e. Koyta, and deadly weapons. Thus, considering the prima-facie material, at this stage, no case is made out for grant of ad-interim protection.
