The dispute pertains to husband and wife.
Wife has lodged a complaint against the husband on the allegation of assault by means of stick, whereby she sustained fracture to the leg.

It appears that by interim protection, the applicant was directed to attend the concerned police station. Accordingly, he attended the concerned police station and co-operated with the investigation. The offence appears to be registered on 13/12/2024. 3.
Learned APP fairly submitted that most part of the investigation is already completed. It is the common submission of the learned counsel for the applicant and the counsel appearing for the complainant that both are together residing in the said house.

Considering the fact that the investigation has already been completed, the applicant has co-operated in the investigation, as well as the fact that the matter appears to be arising out of matrimonial dispute, a case is made out for grant of anticipatory bail. Hence, the following order :-
ORDER
i] The interim order granted to the applicant by order dated 24/12/2024 is hereby confirmed.
ii] The applicant shall appear before the Investigating Officer, as and when directed by him.
