The Applicant is seeking anticipatory bail in connection with C.R No.38 of 2024 registered at Kondoli Police Station, Kolhapur on 26/02/2024, under Sections 406, 420, 465, 467, 468, 471, 474, 475 of the Indian Penal Code. 2.

Heard Dr. Chandrachud, learned counsel for the Applicant and Ms. Dabholkar, learned APP for the Respondent-

State.

The FIR is lodged by one Sushant Patil. He was working as a Senior Clerk in the Office of Sub Divisional Officer, Panhala. The FIR pertains to one permission for construction dated 18/12/2023 purportedly granted to one Sukumar Karve. The informant's office found that the document was suspicious. The inquiry was conducted and it was revealed that the said document was a forged document. The inquiry was made with Sukumar Karve. According to him, he had given this work of getting that permission to one Rajvardhan Patil. Said Patil had taken Rs. 60,000/- for doing that work and had given that forged document to Sukumar Karve. On this basis the FIR is lodged. 4.

Learned counsel for the Applicant submitted that he is conducting E-Seva kendra and such kinds of documents are printed in his centre. The Applicant is not concerned with the forgery. The persons who have forged those documents have used the Applicant's name and registration number to make documents

look genuine. In fact, because of use of Applicant's name, he himself has become a victim at the hands the main offenders and he is apprehending arrest because his name is appearing on the forged documents.

Learned APP, on instructions, submitted that the instances of forgery mentioned in the FIR is not an isolated incident. In fact, it is a big racket and the accused have prepared many forged documents. On some of those documents, the Applicant's name appears. Those documents mentioned that the print out is taken from his centre. She submitted that the Applicant's hard-disk is seized. It is sent to SDM's Office for verification of the authenticity of the documents stored in the hard-disk. She seeks time to take instructions. 6.

Considering both these submissions, at this stage, the Applicant can be protected by way of ad interim relief with directions to attend the concerned police station and to co-operate with the investigation.

Hence the following order.

ORDER

(I) In the event of his arrest in connection with C C.R No.38 of 2024 registered at Kondoli Police Station, Kolhapur, till the next date, the Applicant is directed to be released on bail on his executing P.R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

(ii) This order shall operate till 06/05/2024.

(iii) The applicant shall attend the concerned Police Station on 22nd, 23rd and 24th April 2024 between 1.00 p.m. to 5.00 p.m. and thereafter as and when called. The Applicant shall co-operate with the investigation. (iv) Stand over to 06/05/2024.
