The Applicant is seeking anticipatory bail in connection with C.R.No.553 of 2022 registered at Mahatma Phule Chowk Police Station, District Thane, on 27.09.2022, under Sections 420, 465, 467, 468 and 471 r/w. 34 of the Indian Penal Code. 2.

represented to the informant that he was in a position to get some agricultural land if the informant paid certain amount. The allegations are that the informant paid Rs.65,25,000/-, consisting of certain amounts through cheques, certain amount through U. S. Dollars in cash to the applicant and the owners of the land. The amount paid to the applicant was in U. S. Dollars. Subsequently, the lands were not transferred in the name of the informant and, hence, the offence is registered.

At the outset, learned counsel appearing for the applicant, as well as, learned counsel for the informant submitted that the parties were knowing each other from their Merchant Navy days. The dispute is personal between both, the applicant and the informant. Therefore, they are willing to explore a possibility of settlement through mediation.

Considering these submissions, the parties can be referred for mediation, with ad-interim relief to the applicant. 5.

Hence, the following order.

O R D E R

i) The Applicant, as well as, the first informant shall approach the Mediation Center of this Court on 23.04.2024, at 11:00a.m.

ii) The officer in-charge of the Mediation Center shall appoint a suitable Mediator from their panel to make an attempt to bring about the settlement between the parties.

iii) In the event of arrest of the applicant in connection with C.R.No.553 of 2022 registered at Mahatma Phule Chowk Police Station, District Thane, till the next date, the Applicant is directed to be released on bail on his executing P. R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.

iv) This order shall operate till 20/06/2024. v) Stand over to 20/06/2024.
