The Applicant is seeking anticipatory bail in connection with C.R.No.1752/2022 registered with Sakinaka Police Station, Mumbai on 11.7.2022 under Sections 384, 389, 406, 420, 419, 467, 468, 500 of IPC and under Sections 66 and 67 of the Information Technology Act, 2008. Deshmane(PS)

Heard Mr. Satyavrat Joshi, learned counsel for the Applicant, Mr. S.V. Gavand, learned APP for the Respondent-State and Mr. Rajiv Chavan, learned Senior counsel for the first informant.

The gist of the FIR is that the Applicant is blackmailing the victim by making allegations about their relationship. She is tarnishing his image.

Learned counsel for the Applicant submitted that the informant's wife had lodged her own FIR vide C.R. No.484/2022 registered at Govandi Police Station, Mumbai. The Applicant has preferred A.B.A. No.955/2023 in that subject matter. The Applicant is protected by way of adinterim relief on certain conditions. Therefore, in the present matter also, in which the allegations are overlapping; the Applicant may be protected by way of adinterim relief till the next date. 5.

Learned APP submits that similar conditions, which are imposed in A.B.A. No.955/2023, be imposed in

this application while granting ad-interim relief till the next date.

Considering these submissions, the following order is passed :

O R D E R

(i) In the event of arrest of the Applicant in connection with C.R.No.1752/2022 registered with Sakinaka Police Station, Mumbai, the Applicant shall be released on interim bail till the next date of hearing, on furnishing bail bonds in the sum of Rs.25,000/- with one or two sureties in the like amount ;

(ii) The Applicant shall report to the Investigating Officer for two days i.e., on 14th and 15th May, 2024 between 11:00 a.m. to 02:00 p.m. and further as and when required by Investigating Officer;

(iii) The Applicant shall not publish, transmit or post any obscene pictures or messages concerning the first informant on the social media, till the next date of hearing ;

(iv) The Applicant shall not interfere with the first informant and the other witnesses and shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

(v) The Applicant shall keep the Investigating Officer informed of her current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.

(vi) Stand over to 20.6.2024. To be tagged with A.B.A. No.955/2023.
