The Applicants are seeking anticipatory bail in connection with C.R.No.255/2024 registered with V.P. Road Police Station, Mumbai on 3.4.2024 under Sections 341, 406, 420, 448 read with 34 of IPC.

The FIR is lodged by one of the cousins of the present Applicants. The dispute is about the family business and one shop having three galas at Bhuleshwar. Deshmane(PS)

Advocate Mr.Vimal Sanghani appears and states that he has instructions to appear for the informant. Learned counsel for the Applicants is granted leave to add the first informant as a party Respondent. Amendment shall be carried out forthwith.

Without entering into the merits of the matter, since both the parties are closely related, learned counsel for the parties jointly agree that they can explore a possibility of settlement through mediation.

Considering the close relations between the parties, the matter can be referred for mediation. It is made clear that no observations are made on the merits of the matter. The merits of the matter are left open. In the meantime, the Applicants can be protected by way of adinterim order till the next date so that the mediation process can progress smoothly.

Hence, the following order:

O R D E R

(i) In the event of their arrest in connection with C.R.No.255/2024 registered with V.P. Road Police Station, Mumbai, till the next date, the Applicants be released on bail on their executing P.R. bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand Only) with one or two sureties each in the like amount.

(ii) This order shall operate till 27.6.2024.

(iii) Both the parties shall appear before the Mediation Center of this Court on 6.5.2024 at 11.00 a.m.. The officer in-charge of the Mediation Center shall appoint a suitable Mediator from their Panel to explore a possibility of settlement through mediation.

(iv) Stand over to 27.6.2024.
