Heard learned counsel appearing for the Applicant and learned APP for the State.

This is an application for anticipatory bail in connection with Crim No. 116/2024 dated 13th April, 2024 registered with Jodhbhavi Peth Police Station, Solapur for the offences punishable under Sections 188, 272, 273, 328 of the Indian Penal Code r/w. Sections 26(2)(i), 26(2)(ii), 26(2)(iv) and 27(3) (e) of The Food Safety and Standards Act, 2006.

The contention is that, the Applicant was not on the spot V.A. Tikam

3-ABA-1202-2024.doc and his name has not been appeared in the FIR and he has been made accused only on the statement of the investigating officer. The learned APP objected the application for ad-interim bail on the ground that, there are other offences registered against him. 5.

It appears that the raid is already conducted on 13th March, 2024 and prohibited articles worth Rs.9,28,746/- are already seized. This shows most part of the investigation is already over. Nothing is to seized from the Applicant. 6.

Considering the submissions of both the parties, a case is made out for grant of ad-interim bail.

Hence, following order:

ORDER

(i) Pending the application, in the event of arrest, the Applicant shall be released on bail on furnishing P.R. Bond of Rs.50,000/- with one solvent surety in the like amount. (ii) The Applicant shall attend the concerned police station on every Wednesday for two weeks between 10 am to 12 noon and shall cooperate in the investigation.

(iii) Stand over to 11th June, 2024.
