During the course of arguments, this Court finds that even when the interim order was passed, an offer was made on behalf of the applicant that the balance amount i.e. Rs.35 Lakhs kept with escrow account of concerned Advocate-Mr. Chetan D. Oswal, can be deposited as per directions of the Court to show the bonafide of the applicant. It is also noted that the applicant is a senior citizen, aged about 78 years.

During the course of hearing today also, this Court has gathered an impression that the genesis of the grievance of the informant, which led to registration of the FIR, appears to be a commercial/civil dispute between the parties, wherein the

Event today, the learned counsel for the applicant in the presence of Advocate Mr. Chetan D. Oswal, in whose account as an escrow the amount was deposited, makes a statement that in terms of the interim order, such amount can be deposited forthwith.

In this situation, the learned counsel for the informant seeks time to take instructions.

List this application for further consideration on 11th December 2024, to be included in the supplementary list. 6.
