In this application on 08.05.2024, this Court (Coram: Sarang V. Kotwal, J.) granted interim order in favour of the applicant, primarily on the ground that anticipatory bail applications of two co-accused persons had been allowed by this Court.

The statement of the informant leading to registration of the FIR shows that insofar as the present application is concerned, there is specific role attributable to him of having assaulted the informant / victim by way of a cutter. As against the other accused persons, there is no allegation of use of weapon. On that basis, the learned APP submits that the applicant cannot claim parity with the accused persons, who were granted anticipatory bail.

There is nothing to indicate as to whether the applicant did appear before the investigating officer after the interim order dated 08.05.2024 was passed in his favour. Today, the investigating officer could not remain present.

In that light, list the application for further consideration on 20.11.2024, H.O.B.

On the next date of listing, the investigating officer shall remain present along with the investigation papers. In the meanwhile, the interim order dated 08.05.2024 shall continue to operate till the next date, subject to the applicant appearing before the investigating officer on 18.10.2024 and thereafter as and when called by the investigating officer.
