On the last date of hearing i.e. 9th September 2024, this Court recorded that there was no appearance on behalf of the applicants. The learned APP had made a statement that although, the applicants did appear before the Investigating Officer, but they did not cooperate with the investigation. Accordingly, the applications were kept for today, under the caption "for dismissal".

Today, the learned counsel appeared for the applicants and he submits that there was no appearance on behalf of the
bipin prithiani 902-aba-1319.24 & anr.doc applicants on 9th September 2024, as the learned counsel appearing for the applicants was held up in another Court. 3.
He also submits that substantial amounts were paid to the first informant/bank and it can be demonstrated that the bank has also agreed to issue a conditional NOC to the applicant to dispose of some of the properties.

In this situation, it would be appropriate that the first informant/bank is made a party/respondent in both the applications. Accordingly, leave to amend is granted. The first informant/bank shall be added as party/respondent No.2 in both the applications, forthwith.

Issue notice to respondent No.2 (first informant) in both the applications, returnable on 16th October 2024, to be included in the supplementary list.

The notice shall be issued through the Investigating Officer, for which purpose the applicant shall provide an additional set of papers to the Investigating Officer on or before 26th September 2024.
7.
The interim order shall continue to operate till then. MANISH PITALE, J.
