Heard learned Counsel for the Applicant and learned APP for the Respondent-State.

The alleged incident took place on 29th October, 2022 whereby the complainant assaulted by one Ajit Hoke, Prashant Kadam and two unknown persons, whereby he sustained fracture injury. Therefore, the offence against those persons came to be registered.

The contention is that the Applicant is not named in the First Information Report (for short 'FIR') and no role has been V. A. Tikam

Having gone through the FIR, it appears that one Ajit Hoke and Prashant Kadam, who assaulted the complainant by means of iron rod and wooden sticks respectively, have been arrested and the weapons have already been seized. Prima facie, it appears that the role assigned to the Applicant is that of assault by fist blows.

Considering the submissions and alleged role played/assigned to the complainant, a case is made out for adinterim relief. 5.

Hence, the following order;

ORDER

i.

Pending the Application, in the event of arrest, the Applicant shall be released on bail on furnishing P.R. Bond of Rs.50,000/- with one solvent surety in the like amount; ii.

The Applicant shall attend the concerned Police Station on every Wednesday between 10:00 a.m. to 12:00 p.m. for three weeks.

iii.

Stand over to 26th June, 2024.
