Heard for sometime. The offences is registered against the present Applicant on 11.04.2024, with the allegation that he has committed fraud amounting to Rs.89,77,200/- by issuing duplicate receipts of the marketing committee. From the contents it is seen that the period of offence is stated to be from 01.12.2021 till 24.05.2022. On the said charges even departmental action was initiated resulting into termination of the Applicant in the year 2022 itself. Looking to these dates it is clear that the offence is registered 2 years after the termination. There is no explanation as to why there is such a delay in lodging the FIR. There is also no allegation that during this period the Applicant has tried to influence any witnesses or tried to interfere with the inquiry. Shubham 1/2

This Court finds that a case is made out to issue notice and to grant of ad-interim relief, hence the following order.

ORDER

a) Issue notice to Respondents, returnable on 18th June, 2024. Learned APP waives notice for Respondent/State. b) Till 18th June, 2024, in the event of arrest of the Applicant in connection with FIR No. 0219 of 2024, registered with Panchavati Police Station, Nashik City, he shall be released on bail on executing P.R. bond and solvent surety in the sum of Rs.15,000/-.

c) The Applicant shall not try to influence the investigation. d) The Applicant shall attend the concerned police station as and when called for.

e) The Applicant shall keep informed the concerned Police Station about his residential address, mobile number etc. and other contact details.
