Heard Ms. Dighe, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP appearing for the Respondent-State.

This application is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail in connection with C.R. No.212 of 2024 registered with Chakan Police Station, Pune, for the offences punishable under Sections 336, 353, 504 and 506 of the Indian Penal Code, 1860.

The prosecution case is set out in paragraph No.3 of the order dated 20th April 2024 passed by the learned Additional Sessions Judge, Khed-Rajgurunagar, Pune in Criminal Bail Application No.193 of 2024, which reads as under: "3. Background facts - The informant public servant namely Vaijnath Rama Ebatwar lodged an FIR with Chakan police station alleging therein that the incident in question took place on 30/03/2024. According to informant, at the relevant time, he was discharging his official duty. When he reached to disconnect electricity connection, the applicant came there and started abusing him in filthy language and thereafter thrown stone towards the direction of informant and tried to cause him injury. The informant however, managed to miss the said attack. The applicant thereafter allegedly abused and threatened to life of informant and deter and provoke to discharge his official duty. Hence, this report."

A learned Single Judge by order dated 21st May 2024 granted interim protection which continues till date. 5.

Ms. Yadav, learned APP strongly opposes the Anticipatory Bail Application. She submits that the offence is very serious and is related to Public Officer. However, on instructions, she submits that

the investigation is completed and chargesheet is ready. She submits that same will be filed in the Court within short time. 6.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Aniket Pandharinath Yelwande in connection with C.R. No.212 of 2024 registered with the Chakan Police Station, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the Chakan Police Station, Pune as and when called by the Investigating Officer and shall co-operate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
