In this application, the applicant has approached the Court for granting anticipatory bail as he apprehended arrest in connection with FIR No. 0027 of 2024 dated 12th January 2024 registered at Chaturshringi Police Station, Dist. Pune, for offences under Sections 188, 272, 273, 328 read with 34 of the Indian Penal Code, 1860 (IPC) and Sections 26(2)(i), 26(2)(iv), 27(3)(d), 27(3)(e), 30(2)(a) and 59 of the Food Safety and Standards Act, 2006 (FSSA).

On 17th May 2024, this Court granted interim relief in favour of the applicant on specific conditions. This Court is BIPIN DHARMENDER PRITHIANI DHARMENDER PRITHIANI Date: 2024.10.07 18:38:12 +0530 informed that in terms of condition No.(ii) of the aforesaid order, the applicant indeed attended the concerned Police Station on every Wednesday for 3 weeks from the date of the order and that

This Court in similar cases has granted relief of anticipatory bail by taking note of the fact that the very applicability of Section 328 of the IPC in the facts and circumstances of such cases is in serious doubt and the question is being considered by the Supreme Court in a group of cases. In all such cases, the Supreme Court has granted relief of anticipatory bail and protection from arrest. This Court has been granting protection in a similar manner in such cases.

In view of the above, the interim order dated 17th May 2024 is confirmed and the application is allowed.

The applicant is directed to continue to cooperate with the investigation. He shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.
