On 21st May 2024, this Court (Coram: M. W. Chandwani, J.) had passed the following order :

"1.

The learned APP, on instructions from Investigating Officer, makes a statement that, the Police will not arrest the Applicant till the next date of hearing subject to a condition that the Applicant shall cooperate in the investigation. The statement is recorded and accepted.

2.

In this scenario, the Applicant shall attend the concerned police station on every Monday and Wednesday for two weeks between 10 a.m. to 12 noon and shall cooperate in the investigation.

3.

Stand over to 20th June, 2024."

The learned APP, on instructions, makes a statement that the

bipin prithiani 20-aba-1427.24.doc applicant did attend the Police Station as directed in the above quoted order, but the applicant is not cooperating with the investigation.

As noted hereinabove, today there is no appearance on behalf of the applicant, although the interim order is continued over a period of time.

5.

Hence, list this application on 8th October 2024, to be included in the supplementary list, as a matter of last chance. 6.

It is made clear that if there is no appearance on behalf of the applicant on the next date of listing also, this application shall be dismissed and the interim order shall be vacated. 7.

Till the next date of listing, the interim order shall continue to operate.
