Heard learned counsel for the Applicants, learned APP for the State and learned counsel for Respondent No.2/ Intervenor. 2.
The Applicant is the nephew of the complainant. The allegations against the Applicants are that, Applicant No.1 along with Applicant No.2 and other co-accused, assaulted the victim. The role assigned to Applicant No.1 is that, he assaulted the Informant by wooden stick on his left rib. Thereby he suffered rib fracture. Role assigned to Applicant No.2 is that, he assaulted the victim by stone.

13-ABA 1448 of 2024.doc It is claimed that, the incident is recorded in CC TV footage. The investigating officer has seen CC TV footage and recorded panchnama dated 13th April, 2024 that, the wooden stick was thrown towards the direction of the complainant. There is no reference in the said panchnama whether the Applicant No.1 actually hit the complainant by stick.

Be that as it may, at this stage, Learned APP submits that the investigating officer, who is conducting the investigation, is not present in the Court today.

In view of submission of learned counsel for the Applicants and the learned APP for the State, no coercive action shall be taken against the Applicants till next date of hearing. 6.
The Applicants shall attend the concerned police station on every Monday and Wednesday for three weeks between 10 a.m. to 12 noon till the next date and shall cooperate in the investigation. 7.
Liberty is granted to learned counsel for the Intervenor to file an Affidavit.

Stand over to 26th June, 2024.
