The allegation in the FIR is that the Applicant deposited 80 fake currency notes of denomination of Rs.500/- in cash deposit machine of the bank. It was noticed by the cashier that the notes are fake. It is thereafter she informed this fact to the manager of the bank i.e. Bank of India, Shrungartali branch, Ratnagiri. After confirming the notes to be fake a complaint is lodged for the offences punishable under Section 489-B &

2 15-ABA-1490-2024.doc 489-C. It is the case of the Applicant that she is having account in the said bank since last 20 years. He is having regular transactions with the bank. There was no question of depositing the fake notes in the bank. It is the specific case that this amount he had received from one Rajapur Co-op Bank by way of loan. As on today, there is noting to show that he has produced the notes or he has specific knowledge of the notes being fake. 5.

Considering the above, this Court is satisfied that till the returnable date the Applicant needs to be protected. Hence the following order.

ORDER

(a) Till the next date, in the event of arrest of the Applicant in connection with FIR No.33 of 2024, registered with Guhaghar Police Station, Ratnagiri for the offences punishable under Section 489-B & 489-C of the Indian Penal Code, 1860, he shall be released on bail on furnishing P.R. Bond and solvent surety in the sum of Rs.15,000/-.

(b) The Applicant shall not try to influence the investigation and co-operate with the investigating officer. The Applicant not to tamper with evidence and

(c) The Applicant shall attend the concerned Police Station as and when called for.

(d) The Applicant shall keep informed to concerned Police Station about his residential address, mobile number etc., and other contact details.
