Learned APP waives notice for Respondent/State. 4.

The allegation in the FIR is that the present Applicant and other 15 persons ave committed an offence of abatement to commit suicide. Out of 16 accused 11 are already protected by way of Anticipatory Bail. The alleged role against the present Applicant is that he did not allow the person who committed suicide and the informant from entering into the land of this Applicant. From the FIR it is seen that there was certain

2 22-ABA-1497-2024.doc dealings with the person who committed suicide. He has written a suicide note before committing suicide. From the earlier order passed by this Court dated 10th April, 2024 in ABA No.956 of 2024 the Court has recorded after perusing investigating papers that no case is made out under Section 306 of the Indian Penal Code.

Considering the above aspects it would be in the interest of justice to protect the Applicant till the returnable date. Hence following order.

ORDER

(a) Till the next date, in the event of arrest of the Applicant in connection with FIR No.193 of 2024, registered with Daund Police Station, Pune for the offences punishable under Section 306, 323, 34, 504 & 506 of the Indian Penal Code, 1860, he shall be released on bail on furnishing P.R. Bond and solvent surety in the sum of Rs.15,000/-.

(b) The Applicant shall not try to influence the investigation and co-operate with the investigating officer. The Applicant not to tamper with evidence and not try to pressurize any of the witnesses.

3 22-ABA-1497-2024.doc (c) The Applicant shall attend the concerned Police Station as and when called for.

(d) The Applicant shall keep informed the concerned Police Station about his residential address, mobile number etc., and other contact details.
