Heard learned counsel for the applicant and learned APP for respondent-State.

The learned counsel for the applicant submits that in the present case, the FIR was registered under Section 397 of the Indian Penal Code, 1860 (IPC) against three unknown persons, who were alleged to have carried out the alleged act and the assault on the victim/informant.

The Sessions Court has observed in its order dated 14th June 2024, while rejecting the application for anticipatory bail of the applicant that the three accused persons upon being arrested informed that they had carried out the act at the instance of the applicant, who had old rivalry with the informant. This Court is informed that all the three arrested accused persons have been enlarged on regular bail.

The learned APP submits that instructions are awaited from the Investigating Officer and that the material available with the Investigating Officer would be placed before this Court on the next date of hearing.

At this stage, this Court is of the opinion that a prima facie case is made by the applicant in his favour, as he is not named in the FIR. Three unknown persons were eventually arrested by the Police and on their statement the applicant is sought to be connected with the incident in question.

In view of the above, the following interim order is passed : (a) Till the next date, in the event the applicant is arrested in connection with FIR No.0195 of 2024 dated 28th April 2024 registered at Satara Police Station, Dist. Satara, he shall be released on bail on furnishing PR Bond of Rs.25,000/- and one surety in the like amount to the satisfaction of the trial Court.

(b) The applicant shall remain present before the Investigating Officer on 29th June 2024 between 10:00 a.m. and 12:00 noon and thereafter, as and when called by the Investigating Officer. The applicant shall cooperate with the investigation. (c) The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the

informant, witnesses and other persons concerned with the case.
